These Terms of Service ("Terms") govern your access to and use of the TheFitnessDB website, API, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Definitions
"TheFitnessDB," "we," "us," and "our" refer to the operator of the Services. "You" and "your" refer to any individual or entity accessing or using the Services. "API" refers to the TheFitnessDB REST API. "Content" refers to any data, text, images, or other materials available through the Services.
2. Account Registration
To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
3. API Usage
API access is subject to the rate limits and usage quotas associated with your subscription tier. You may not exceed your allocated rate limits, share API keys with unauthorized third parties, or use the API in a manner that degrades the experience of other users. We reserve the right to throttle or suspend access for any account that violates these terms.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with our Acceptable Use Policy. You may not use the Services to transmit malware, attempt to gain unauthorized access to our systems, scrape the Services beyond your API allocation, or resell API data without an appropriate license.
5. Intellectual Property
The Services and their original content (excluding user-submitted content) are and shall remain the exclusive property of TheFitnessDB. Our exercise data, taxonomies, and anatomical cross-references are proprietary. Your API subscription grants you a limited, non-exclusive, non-transferable license to use the data in accordance with your tier's terms.
6. Payments and Billing
Paid Services are billed in advance on a monthly or annual basis through Stripe, which acts as our Merchant of Record. Stripe handles all payment processing, VAT, and sales tax obligations globally. Prices are listed in USD and EUR. You agree to provide accurate billing information and authorize recurring charges for your subscription.
7. Cancellation and Refunds
You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. We do not provide prorated refunds for unused time within a billing period. For annual subscriptions, refund requests within the first 14 days may be considered on a case-by-case basis.
8. Limitation of Liability
The Services are provided "as is" and "as available." To the maximum extent permitted by law, TheFitnessDB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Medical Disclaimer
The exercise and anatomical data provided through the Services is for informational purposes only and does not constitute medical advice. Always consult a qualified healthcare professional before beginning any exercise program or making clinical decisions. TheFitnessDB is not responsible for any injury or health outcome resulting from the use of our data. You may not submit patient identifiers or protected health information (PHI) through any of our Services.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email at least 30 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which TheFitnessDB is registered, without regard to conflict of law provisions.
